JAM-Pidum Setujui Sembilan Pengajuan Restorative Justice

𝙅𝙖𝙠𝙖𝙧𝙩𝙖, 𝘿𝙣𝙪𝙨𝙖𝙣𝙩𝙖𝙧𝙖𝙥𝙤𝙨𝙩.𝙘𝙤𝙢.- Jaksa Agung melalui Jaksa Agung Muda Tindak Pidana Umum (JAM-Pidum) Dr. Fadil Zumhana menyetujui sembilan permohonan penghentian penuntutan berdasarkan keadilan restoratif.

Ekspose dilakukan secara virtual yang dihadiri oleh JAM-Pidum Dr. Fadil Zumhana, Direktur Tindak Pidana Terhadap Orang dan Harta Benda Agnes Triani, S.H. M.H., Koordinator pada Jaksa Agung Muda Bidang Tindak Pidana Umum, Kepala Kejaksaan Tinggi dan Kepala Kejaksaan Negeri yang mengajukan permohonan restorative justice serta Kasubdit dan Kasi Wilayah di Direktorat T.P. Oharda. Senin (8/8/22).

Berdasarkan siaran pers tertulis yang dikeluarkan Pusat Penerangan Hukum Kejagung RI, sembilan berkas perkara yang dihentikan penuntutannya berdasarkan keadilan restoratif yaitu:

  1. Tersangka SITI SUWARNI ALS HANYA BIN ALM. SULAIMAN dari Kejaksaan Negeri Aceh Tenggara yang disangka melanggar Pasal 351 Ayat (1) Jo Pasal 352 KUHPidana tentang Penganiayaan.
  2. Tersangka ZAHARA BINTI ALM. EFFENDI dari Kejaksaan Negeri Sabang yang disangka melanggar Pasal 351 Ayat (1) KUHPidana tentang Penganiayaan.
  3. Tersangka DERWINA, SE BINTI JOHAN dari Kejaksaan Negeri Sabang yang disangka melanggar Pasal 351 Ayat (1) KUHPidana tentang Penganiayaan.
  4. Tersangka M. FAISAL FUADI BIN ISHAK dari Kejaksaan Negeri Pidie Jaya yang disangka melanggar Pasal 310 Ayat (3) UU RI Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan.
  5. Tersangka KENTANI KARNADO BIN MUHAMMAD ROKAH dari Kejaksaan Negeri Lhokseumawe yang disangka melanggar Pasal 351 Ayat (1) KUHPidana tentang Penganiayaan.
  6. Tersangka MARHABAN ALIAS AMAN SUM BIN ALM. ABDUL MUTALIP dari Kejaksaan Negeri Gayo Lues yang disangka melanggar Pasal 351 Ayat (1) KUHPidana tentang Penganiayaan.
  7. Tersangka MUHARIADI ALS MUHAR BIN RABIIN (ALM) dari Kejaksaan Negeri Aceh Tenggara yang disangka melanggar Pasal 351 Ayat (1) KUHPidana tentang Penganiayaan.
  8. Tersangka MURTINI BINTI MANYAK dari Kejaksaan Negeri Aceh Timur yang disangka melanggar Pasal 351 Ayat (1) KUHPidana tentang Penganiayaan.
  9. Tersangka AHMAD EFENDI ALIAS FENDI BIN (ALM) ABDULLAH dari Kejaksaan Negeri Mempawah yang disangka melanggar Pasal 351 Ayat (1) KUHPidana tentang Penganiayaan.

Alasan pemberian penghentian penuntutan berdasarkan keadilan restoratif ini diberikan adalah:

  1. Telah dilaksanakan proses perdamaian dimana Tersangka telah meminta maaf dan korban sudah memberikan permohonan maaf.
  2. Tersangka belum pernah dihukum.
  3. Tersangka baru pertama kali melakukan perbuatan pidana.
  4. Ancaman pidana denda atau penjara tidak lebih dari 5 (lima) tahun.
  5. Tersangka berjanji tidak akan lagi mengulangi perbuatannya.
  6. Proses perdamaian dilakukan secara sukarela dengan musyawarah untuk mufakat, tanpa tekanan, paksaan, dan intimidasi.
  7. Tersangka dan korban setuju untuk tidak melanjutkan permasalahan ke persidangan karena tidak akan membawa manfaat yang lebih besar.
  8. Pertimbangan sosiologis.
  9. Masyarakat merespon positif.

Selanjutnya, JAM-Pidum memerintahkan kepada Para Kepala Kejaksaan Negeri untuk menerbitkan Surat Ketetapan Penghentian Penuntutan (SKP2) Berdasarkan Keadilan Restoratif sesuai Peraturan Kejaksaan Republik Indonesia Nomor 15 Tahun 2020 dan Surat Edaran JAM-Pidum Nomor: 01/E/EJP/02/2022 tanggal 10 Februari 2022 tentang Pelaksanaan Penghentian Penuntutan Berdasarkan Keadilan Restoratif sebagai perwujudan kepastian hukum.
